Terms of Service
These Terms of Service (hereinafter “the Terms”) govern access to and use of Seolup, the cloud-based platform (software as a service) available at seolup.io and at the application app.seolup.io (hereinafter “the Service”). By creating an account or using the Service you accept these Terms in their entirety. If you do not agree, do not use the Service.
1. Service provider details
The Service is owned by:
- Owner: John Guerrero
- Trading name: Seolup
- Address: Madrid, Spain
- Email: hello@seolup.io
2. Description of the Service
Seolup is a keyword research tool based on SERP vulnerability: it identifies low-competition keywords by analyzing the real weakness of search results, beyond theoretical difficulty scores. The Service includes a web interface and an MCP server that allows AI agents (such as Claude or ChatGPT) to run the research.
Early access: the Service is in an early access phase. Some features may change, be limited, or contain errors, and certain advanced capabilities are announced for future versions. We will inform you of material changes.
3. User account
To use the Service you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that takes place under your account. You must have the legal capacity to enter into a contract; if you act on behalf of a company, you represent that you are authorized to bind that company to these Terms.
4. Plans, credits and billing
The Service is offered through a free plan and paid subscription plans:
- Free plan: includes a limited number of daily analyses (currently five analyses per day). The limits of the free plan may vary.
- Paid plans: extend the limits and features. The prices and features of each plan are set out on the pricing page.
- Credits: usage of the Service is measured in credits. The same credit balance is shared between the web interface and the MCP server. Credits included in each billing cycle are non-transferable and not redeemable for cash.
5. Cancellation and refunds
Subscription payments are processed through Stripe. Unless otherwise stated, subscriptions renew automatically at the end of each period (monthly or annual) at the then-current price, until you cancel.
You may cancel your subscription at any time from your account; the cancellation will take effect at the end of the current billing period and you will keep access until then. If you are a consumer, you have the withdrawal rights recognized by applicable law. Unless required by law or expressly stated otherwise, amounts corresponding to periods already started are non-refundable.
6. Acceptable use
You agree to make lawful and appropriate use of the Service. In particular, the following is prohibited:
- Using the Service for unlawful purposes or in a way that infringes third-party rights.
- Attempting to access systems without authorization, overloading them, or interfering with their operation.
- Reselling, redistributing, or exploiting the Service or its data without our express written permission.
- Automating use beyond the provided means (the MCP server) or circumventing credit or rate limits.
7. Data and results of the Service
Analyses, SERP vulnerability scores, and keyword suggestions are provided for informational purposes and to support decision-making. They are based on third-party data (SERP data providers) and on estimates, and therefore we do not guarantee their accuracy, completeness, or timeliness.
We do not guarantee any ranking results. Search engine rankings depend on numerous factors beyond our control, and use of the Service does not ensure improvements in rankings, traffic, or revenue.
8. Intellectual property
The name “Seolup”, the logo, design, software, and other elements of the Service are owned by the owner or by third parties who have authorized their use, and are protected by intellectual and industrial property law. These Terms do not transfer any rights over them to you, beyond the limited, revocable, non-exclusive license to use the Service in accordance with these Terms.
9. Availability and liability
The owner strives to keep the Service operational but does not guarantee uninterrupted availability or error-free performance, particularly during the early access phase. The Service is provided “as is” and “as available”.
To the fullest extent permitted by law, the owner shall not be liable for indirect damages, loss of profits, or loss of data arising from the use of, or the inability to use, the Service. Nothing in these Terms limits any liability that cannot be excluded by law, including the rights that consumer protection regulations grant to consumers.
10. Suspension and termination
We may suspend or terminate your access to the Service if you breach these Terms or if your use jeopardizes the security or operation of the Service. You may stop using the Service and close your account at any time.
11. Changes to the Terms
We may modify these Terms to adapt them to legal changes or to changes in the Service itself. We will notify you of material changes with reasonable advance notice. Continued use of the Service after the changes take effect constitutes acceptance.
12. Data protection
The processing of your personal data is governed by our Privacy Policy and our Cookie Policy, which form an integral part of these Terms.
13. Governing law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals that apply under the relevant regulations, without prejudice to the jurisdiction legally afforded to consumers and users.
14. Contact
For any query regarding these Terms, you can write to hello@seolup.io.
